About half of the estates I handle have no will. The family is often surprised to learn that the law already has a plan, and that nobody was asked.

Who is in charge

Nobody, until a court appoints an administrator. Until then no one can sell the house, close the accounts or sign for repairs. Getting that appointment is the first job.

Who inherits

The law sets an order: spouse and children first, then parents, then brothers and sisters. A partner you were not married to is not on the list. Stepchildren usually are not either.

What a will changes

You choose who is in charge and who inherits, and you can say who should look after your children. A simple will takes one meeting and costs less than most people guess.
